The German medical sector allows a possible discrepancy regarding the willingness of organ donation stated by a patient between an organ donation card and a living will. This empirical study examines the handling in case of conflicted documented intents within these two forms. This has been evaluated by creating a questionnaire which was handed out to 433 doctors and nurses working at the Universitätsmedizin Göttingen. The return rate was 26%. It became apparent that there is much uncertainty regarding the handling of those two forms. Most of the nurses but also many doctors use the relatives for help finding a descision, especially when only the patients will against life-sustaining measures is documented. Overall the nurses were more reluctand regarding an organ transplantation than the doctors. A few nurses even preferred the living will and disregarded the organ donation card even though both forms presented the patient’s will and needed to be considered. Additionally, in the questionnaire it showed (that most of) the nurses and doctors needed and also wanted more support making the decision. Even though there are references regarding the decision making, the majority of the medical staff was not aware of them. Furthermore, the results of the questionnaire showed a demand for assistance and consultation in making those decisions.de
