The present dissertation deals with the legal status of the individual as an individual under international law and the historical development of Article 25 sentence 2 of the Basic Law since the Basic Law was passed in 1949. Sporadic voices in literature advocate Article 25 sentence 2 of the Basic Law as an individual basis for claims against violations of general rules of international law In any case, German case law has also developed sympathy for this position in the upper courts since 2000. The dissertation takes a critical look at how Art. 25 sentence 2 GG is to be assessed and also takes into account decisions of international courts.

Die vorliegende Dissertation befasst sich mit der Rechtsstellung des Einzelnen als völkerrechtliches Individuum und die historische Entwicklung des Art. 25 Satz 2 GG seit Erlass des Grundgesetzes im Jahr 1949. Vereinzelt befürworten Stimmen des Schrifttums Art. 25 Satz 2 GG als individuelle Anspruchsgrundlage gegen Verletzungen allgemeiner Völkerrechtsregeln, und auch die deutsche Rechtsprechung hat jedenfalls obergerichtlich seit 2000 Sympathie für diese Haltung entwickelt. Die Dissertation betrachtet kritisch, wie Art. 25 Satz 2 GG zu werten ist und berücksichtigt dabei auch Entscheidungen internationaler Gerichte.
